Principles in Administrative Law

Administrative Law Principles

 *1. Wednesbury Principle -
The court does not look at the merits, only the rationality of the process.

 *2. Proportionality Rule -
The court examines if the restriction on a right is more than necessary to achieve the goal.

 *3. Rules against Bias -

 Types of Bias :

 Pecuniary Bias : Any financial interest, however small.

 Personal Bias : Relationship or enmity with a party

 Subject-Matter Bias : Pre-conceived notions or policy rigidness.

 *4. Discretion - Discretion must be exercised reasonably and within the law.

 Grounds for misuse include:

 Mala Fides (Bad Faith) : Acting with personal spite or fraudulent intent.

 Irrelevant Considerations: Taking into account factors the law didn't intend.

 Colorable Exercise of Power: Using a power for a purpose other than what it was granted for.
